DAILY FILE – The Court of Appeal sitting in Ibadan, the capital of Oyo State on Monday set aside the judgement of Governorship Election Petition Tribunal declaring the governor of the state, Seyi Makinde, as the winner of the February 23 election.
The appeal was filed by the All Progressives Congress, APC governorship candidate, Bayo Adelabu against Mr Makinde of the Peoples Democratic Party, PDP.
In a four-against-one judgement, the five-man panel said the tribunal judgement was perverse but did not give an order for a fresh election or a retrial.
The court held that there was a miscarriage of justice at the tribunal, and that Mr Adelabu’s right to fair-hearing had been breached.
The court said it could not grant a consequential order for a retrial of the case as the 180 days prescribed by law for a tribunal to decide election matters had elapsed.
